The National Prosecuting Authority (NPA) will return to the Gqeberha High Court to argue for leave to appeal the acquittal of Timothy Omotoso, a Nigerian televangelist, and his co-accused, Lusanda Solani and Zikiswa Sitho.
They were acquitted earlier this year on charges of rape and human trafficking. Judge Irma Schoeman ruled that the state failed to prove its case beyond a reasonable doubt, citing poor cross-examination, weak witness management, and procedural missteps by the prosecution.
The case, which began in 2017, involved Omotoso allegedly using his position as a religious leader to exploit young women at his Jesus Dominion International Church in Durban.
The state had failed to prove its case beyond a reasonable doubt.
The NPA will argue for leave to appeal this decision on Monday.
